NC State of emergency

Gov. Perdue has declared a state of emergency following deadly storms that hit North Carolina on Saturday.

Do we carry with CCW in Charlotte ? Technically I assume is NO...:confused:

As far as not carrying I don't know if your Gov can suspend carry permits.. BUT after the Hurricane Katrina nonsense that New Orleans Police Chief Eddie Compass tried pulling with gun confiscations there was a Federal law enacted. It basically states you cannot be compelled to give up your firearm so long as you are not prohibited from owning it AND you are not accepting aid for rescue. Stay in your house and don't accept the boat ride and you keep your gun. Need the help and they require you to give it up and thats what you would have to do if you get in their boat.

I'm glad you guys made it through okay. We were missed thankfully. There sure was allot of damage thoughout the state. All we lost was our telephone service and internet from Saturday afternoon until sometime early this morning. Be care of downed powerlines they aren't very forgiving.

I don't know what they laws are about carrying during a State of Emergency in NC. I had to run to the store yesterday and my Ruger was in my pocket as usual. Unless you're doing something stupid who will know if you're carrying or not.

Reading the state of Emergency document from the Governor website on section n.7

It does not trigger the limitations on weapons in G.S. 14-288.7 or impose any limitation on the compsuntion,transportation,sale or purchase of alcoholic beverages

Anyone besides me think it is odd that this is a Republican bill that confiscates your guns?? And everyone tells me that is it the Democrats that want to take them.

The Disaster Recovery Personal Protection Act of 2006 was a bill introduced in the United States Congress intended to prohibit the confiscation of legally-possessed firearms during a disaster. Its provisions became law in the form of the Vitter Amendment to the Department Of Homeland Security Appropriations Act, 2007.

However, the temporary surrender of a firearm could be required "as a condition for entry into any mode of transportation used for rescue or evacuation".


Are you refering to the above,which prevents confiscation except "voluntary surrender" on acceptance of rescue. Or is there some Rebublican gun confiscation law I am unaware of. I don't see the conditions set as consfication as you do have a choice,keep your gun don't get rescued or evacuated. But hey don't let me stop a good Rebublican bash :rolleyes:.

You are not giving up anything. It's your Choice if you do not want to surrender your weapon voluntarily your on your own as far as rescue. You still have your 2nd admandment rights,your just on your own. It is basically the same as an LEO giving you a ride from a broken down vehicle. He will check you for any weapons you have and hold them till you leave his vehicle. At least that's how they use to train in the old day's in my area. OMO

14‑288.7. Transporting dangerous weapon or substance during emergency; possessing off premises; exceptions.

(a) Except as otherwise provided in this section, it is unlawful for any person to transport or possess off his own premises any dangerous weapon or substance in any area:

(1) In which a declared state of emergency exists; or

(2) Within the immediate vicinity of which a riot is occurring.

(b) This section does not apply to persons exempted from the provisions of G.S. 14‑269 with respect to any activities lawfully engaged in while carrying out their duties.

(c) Any person who violates any provision of this section is guilty of a Class 1 misdemeanor. (1969, c. 869, s. 1; 1993, c. 539, s. 192; 1994, Ex. Sess., c. 24, s. 14(c).)
