I do think you should have it looked at. When at half cock (or full cock) you should NOT be able to push on hammer and it falls back down. The whole purpose of half cock is to safely hold the hammer away from the firing pin while you load 5 shells. Load 1, skip 1, and load 4 more.

If it is 'sticking' other than at half cock (and full cock) then I'd tear it down and have a peak at the insides and look for crud or damage.

not a smith in 4 hours any direction from me so I will tear it down tonight and post pics. Lock up was good and the timing was spot on so I put 50 rnds through it. it's an accurate little thing and the trigger is so freaking light.

If you don't mind having the transfer bar installed you could send it to Ruger they do it free, and I'm sure your gun will come back fixed from what ever problem it's having, to do the Transfer bar I think they send you a shipping box not sure if they pay shipping? someone here might know.

Yes but I would rather not ruin the trigger feel at the moment it's awesome.
if I cant get it sorted out sending it to ruger will be a last resort
