I think in some states like Texas you can shoot someone trying to steal your car in your driveway.

Yeah or like a bank robber gathering everyone together and trying to get them to go into the vault. In that case I would assume he's going to shoot everyone in the vault and I'll try to shoot him before he gets that chance.
