(d) Subsection (a) shall not apply to—
(1) the lawful performance of official duties by an officer, agent, or employee of the United States, a State, or a political subdivision thereof, who is authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of any violation of law;
(2) the possession of a firearm or other dangerous weapon by a Federal official or a member of the Armed Forces if such possession is authorized by law; or
(3) the lawful carrying of firearms or other dangerous weapons in a Federal facility incident to hunting or other lawful purposes.
What makes it bad is even though its legal you would most likely be arrested and charged. Court cases have gone both ways so even though its legal it doesn't mean you won't have problems. |
The legal opinions I've seen say that the law gives a specific exemption to the Postal Service, so that the CFR is the controlling legal principle. I'm not a lawyer, so I just have to take their word for it.
Clearly, the Feds don't allow us mere citizens to carry guns in federal facilities (not even the buildings in National Parks or National Forests), so it would end up in court, with the citizen playing the role of "defendant". Not a fun role in federal court.
Considering the history of gun violence in postal facilities (see: "going postal"), I think that citizens have more to fear from the postal workers and the other way 'round. This is just one of the reasons I try to spend as little time in the Post Office as possible.

The Federal facility that I work at cites the USC (the federal law) in the dangerous weapons policy, but doesn't include the part (3) part about hunting or otherwise lawful purposes. It ignores that part completely
Another apparently untested area is outside parking lots (not post offices) serving federal buildings. The common interpretation is the law covers adjacent property even though it's not in the interior of the building.

I carry everywhere I legally can. "no guns" signs on business (banks, malls, restaurants) have to legal weight in Florida. Concealed is concealed & what they don't know won't hurt them

I rarely carry, but a sign in a business would not stop me. Courthouses and federal buildings, no.

I carry EVERYWHERE except Government buildings! It may not be my main CC but my backup, which unless you frisk me no one would have a clue. As the saying goes if you don't have it and need it, well... I think we all know that answer.

I carry concealed for a reason. If it's only a gunbuster sign on a business like a mall, restaurant, etc., I could give a flip. I'm carrying. If they don't like it, they can ask me to leave.
That being said, I certainly won't go out of my way to frequent establishments that don't respect my right to defend myself and my family. |

So far in my little party town I have only seen/heard of two establishments sporting signs: *No Weapons*, I guess there might be more but not on my usual stops.
I would just stay away but it's not necessary because I have no use for their products, one's a bar and the other a "Hospice" retail store.

In NH, I can't conceal carry in a courthouse. Federal law, I think, states no guns in Fed buildings. If I know I am going where I can't carry I don't bring my firearm. So yes, I still shop there or I should say my wife does. The local mall lists no shopping. I go there sometimes, if I have to because I hate malls. It doesn't do any good to not go unless you declare your intentions to management. IMHO. Yiogo

Yea but that's different,
I won't carry in a courthouse either, Gov't building, ect.
But I'm not shopping there either and I have no choice.
I will however use FedEx before the Post Office.
I do have a choice when it comes to buying goods and produce.
If we don't assert and fight for our rights, and change mindsets,
We will lose them as they eventually get erodded away, slowly but surely
