Theatre Shooting

Been following this story since it happened and am not surprised that the self defense argument is not holding water. At the end of this, I predict the shooter is going to go away for a long time.

Stand your ground laws are written by well intentioned, but often not very thoughtful legislators - the laws are vague and the conditions under which they apply are not well defined. As such, these cases are eventually defined by case law; unfortunately people are unnecessarily killed or wounded in the process.

Nothing wrong with the law. The error was the former cops execution of it. Is getting popcorn thrown on you justification for lethal force?, the answer isn't hard.
Take Florida case law you spoke of, Zimmerman was cleared by proper execution, the bad guy was approched, bad guy retreated then returned and got his just reward. The cops is the opposite case.

Stand Your Ground had nothing to do with this case. That has to do with retreating from the confrontation. Guy was with his wife in a dark and crowded theater. He could not retreat. His problem is it was not reasonable to fear for his life from thrown popcorn. He seems to have shot because he was not being treated with proper respect. That is not self defense under the law anywhere.

Based on this account, it appears he made three fundamental and critical errors. Any one would be bad,,,,,,
1). He took part in the conflict escalation. This negates or at least weakens his self defense claim.
2). Popcorn, and even the perceived cell phone, throwing make for a weak argument that he feared for his life.
3). Post shooting statement of regret.

This poor example reinforces critical responsibility of CCW holders.
A). Don't escalate a conflict, especially when carrying. Take the high road.
B). Don't draw unless you believe your life (or great bodily harm) is in danger.
C). Post shooting: only state simple facts, hold your opinion to your self, and seek legal advice.

B) can be subjective and it is challenging when someone is judged what they did in seconds under duress by a jury who will decide with plenty of time without stress. But thinking through scenarios today and training might help when an emergency arises. A) and C) can be prepared and practiced. Practice deescalating arguments or walking away and seek legal advice now to know what you would say post shooting.

Definitely do not feel a 'stand your ground' defense is proper after reading what happened. I will say this, it's pretty maddening when someone wont put their phone down in a theater, but no one needs to lose their life over it.

There is a cure for annoying people in theaters. Home theater.

There was no excuse for his use of force. At one point he walked away to complain to management, but returned to escalate the incident instead of just changing seats.

Like all of these stories, we don't get all the facts. With what information is publicly available, I'd say this guy deserves to be locked up for the rest of his life. One of the first things one has to get their head around when carrying is, you got to be willing to turn the other cheek nearly infinitely more than when you're unarmed.
